The following c onditions apply where the relat ionship of landlord and tena nt exists, reg ardless of any agreement,

declaration, l ease, waiver, or other statement t o the contrary: Conditions :

The tenant may assi gn or sublet the residenti al premises to another person wi th the consent of the landl ord. The

landlord m ust respo nd to the te nant in writing within 14 days of the tenant ’s request to sublet or assign the premises.

The tenant may assume t he landlord agrees to the subl et or assignment if the l andlord does not respond to the

tenant’s requ est within 14 days. The la ndlord cann ot unre asonably withhold consent to ass ign or sublet.

Neither the tenan t nor t he landl ord may c hange or add a lo ck or se curity device ( for exampl e, a do or chain ) to

residential premise s unless both agree , or unless ordered by an arbitrator. In an emerg en cy, the landlord may change

the lock on th e main doo r of the reside ntial property a nd the tena nt may cha nge a defec tive lock on the residential

premises and promptly pr ovide the other par ty with a copy of the new key. 3. Entry of Resid ential Premises by t he Landlor d The landlord may ent er the resi dential premises only if one of the f ollowing applies:

• The landlord gi ves the tenant a written notice which st ates why the l andlord needs to enter the res idential

premises and specifi es a reasonable ti me not soone r than 24 hours from the tim e of giving notice. The

landlord m ay enter the residen tial premis es betwe en the ho urs of 8 a.m . and 8 p.m . The lan dlord ma y not

enter the rental unit on the tenant’s day of worship or holi days. • T here is an emergency;

• T he tenant gives the l andlord permission to enter at t he time of entry or not more than one month before the

time of entry for a speci fic purpose; • T he tenant has abandoned the res idential premises;

• The landlord must give the tenant 24 - hour notice i f he or she wi ll be showing the ren tal unit to prosp ective

renters or buyers;

• If the landlord needs to do repairs or insp ect repairs, he or she mu st give 24 - hour notice to the tenant.

4. Pets and Smoking
