A Massachusetts month-to-month rental agreement, also referred to as a “tenancy-at-will”, is a formal short-term rental agreement between a landlord and a tenant. A tenancy-at-will has no end date and either party is permitted to amend or terminate the agreement with at least thirty (30) days’ written notice. Any amendments or terminations that occur need to adhere to whatever rules are stipulated by the rental agreement and cannot violate any of Massachusetts ’s legal minimum termination requirements. It’s advisable for the landlord to accept rental applications so they can run background checks on potential tenants before implementing a rental agreement.
Termination notices must be provided by either party within the same number of days that exist between regular rent-payment dates. For example, if a tenant pays rent every thirty (30) days, either party has to provide a minimum of thirty (30) days advance notice to the other party before terminating the tenancy.
